Overcast is a subscription-based SaaS service and by signing up for a subscription, you agree to pay the applicable fees for the subscription plan you choose, as well as any applicable taxes.
We will automatically bill you for the subscription upon it's expiry, it is your responsibility as a customer to cancel any subscriptions in a timely manner.
We have the right to change our pricing modals at any time, however we will notify users well in advance before this happens so they can either cancel or accept the new subscription prices.
All payments must be made through the payment methods provided on the Overcast website and if it is not supported it will not be accepted.
Unsuccessful payments will lead to a termination of a subscription back to the free tier of the application and removal of the users data.
The data generated on the site by users may be visible to other users making the same scan. By using the service, you understand and agree that your data may be visible to other users and that the data generated through the service may not be fully accurate or complete.
Scanning websites or endpoints that either do not have permission for, whether this is through Bug Bounty or a contractual Penetration Test - is strictly prohibited and will result in account suspension. Overcast Security keep historical logs on what users have scanned what and we reserve the right to ask for proof of permission in any cases where we do not think it exists. If a user fails to provide permission they will be suspended from the platform. It is a users responsibility for gaining the appropriate permission before scanning and Overcast Security has the right to take action on users who cannot provide evidence of this.
The Overcast Platform aims to update data points 3/4 times a day, this may not always be the case and is expected to be accepted by users. We aim to keep the data as accurate and up to date as possible, however this cannot be 100% guaranteed. It is also to be stated that if two users have the same target root domain, there is a high chance that data will be shared amongst users.
You may cancel your subscription anytime either through the Overcast Web application or by contacting us through the contact form provided on the Overcast website. Upon cancellation, you will continue to have access to the service through the end of your current billing period.
We reserve the right to terminate or suspend your subscription at any time, without notice, if we determine that you have violated these terms and conditions or if you use the service in a manner that is harmful to us or to other users.
We do not warrant that the service will be uninterrupted or error-free but we will ensure our best efforts are directed towards provided a stable and reliable service and fix any issues as fast as possible.
We do not attest to the accuracy and reliability of any information generated from the platform, the responsibility is on you, the end user, to verify the accuracy of any generated information you use from the service.
To the maximum extent permitted by law, we will not be liable for any damages resulting from the use of the service, including but not limited to direct, indirect, incidental, punitive, and consequential damages.
Liability will fall onto you, the end-user, who has caused such damages and they will be liable for providing the appropriate compensation and any legal action that may come their way.
If any provision of these terms and conditions is found to be invalid or unenforceable, that provision will be enforced to the maximum extent possible, and the remaining provisions will remain in full force and effect.
These terms and conditions, and your use of the service, will be governed by and construed in accordance with the laws of the United Kingdom, without giving effect to any principles of conflicts of law.
We reserve the right to modify these terms and conditions at any time and upon making any changes they will be effective immediately once posted on Overcast website. Your continued use of the service after the changes have been made will constitute your acceptance of the revised terms and conditions.
